Medication Error

$1.725 million Hennepin County settlement (combined two defendants) related to an alleged medication error resulting in permanent injury. Settlement reached subject to a mutual confidentiality agreement precluding the disclosure of any additional facts. Expert opinions were provided by treating family physician and psychiatric nurse practitioner.

Jury Awards $1.1 Million In Wrongful Death Case

A jury returned a $1.1 million verdict in a wrongful death case involving medical negligence by a family-practice physician employed by a large health care organization. Hallberg Law, P.A. – representing the surviving husband and heirs of a woman who died after suffering cardiac arrest hours after being released from a hospital – presented testimony at trial establishing that by failing to complete a thorough evaluation to rule out an acute coronary event through monitoring and diagnostic testing prior to discharging the woman, a family-practice physician failed to follow accepted standards of practice for physicians in similar circumstances. The jury found that the defendant, operating through its employee family-practice physician, was negligent in the care provided to the deceased woman and that the physician’s negligence was a direct cause of her death.

“No verdict can undo a tragic loss of life,” said Mark Hallberg. “What this jury’s decision has done, however, is demonstrate that we can hold companies accountable when they cause harm through negligence.”

Undiagnosed Obstructive Sleep Apnea Causes Post-Operative Death

Hallberg Law, P.A. obtained a $475,000 settlement for a widow when her 46-year-old husband died following kidney surgery. It was alleged that the hospital staff was negligent in failing to recognize that the patient suffered from obstructive sleep apnea (OSA) and, therefore, failed to provide adequate monitoring and airway management during the first post-operative day. Expert medical opinion established that the combination of OSA and narcotic pain medication in the immediate post-operative period exposed the patient to increased risk of airway obstruction leading to cardiopulmonary arrest.

Below-Standard Spine Surgery Causes Paraplegia

A 61-year-old retired railroad worker received a $1.6 million settlement as compensation for paraplegia resulting from inappropriate spine surgery. The neurosurgeon inappropriately attempted a 10-level decompression of the spine for spinal stenosis in a patient with multiple risk factors. During surgery, the patient suffered severe hypotension leading to the inadequate blood supply to the spinal cord, which resulted in paraplegia. Hallberg Law, P.A. obtained qualified expert opinions from a spine surgeon, life care planner, economist and anesthesiologist to negotiate the settlement.

Inattentive Driver Of Tractor-Trailer Causes Death

Hallberg Law, P.A. obtained a $575,000 recovery for the family of a 46-year-old single woman who was killed when she was struck from behind by a tractor-trailer while she was stopped at a red traffic light. Investigation and discovery initiated by the firm established that the truck driver was drowsy for several miles prior to the collision. He had been driving erratically and failed to pull over to rest before falling asleep at the wheel.

Misread CT Scan Leads To Deadly Delay In Diagnosis

The family of a 73-year-old widow received a $300,000 settlement through the work of Hallberg Law, P.A. The woman had a perforated colon which was not diagnosed appropriately because a radiologist failed to correctly interpret a CT scan. An expert radiologist was prepared to testify that the CT scan demonstrated “free air” in the abdomen, indicating a perforated colon. Although the perforation was repaired 24 hours after admission to the hospital, the patient became septic and died. The patient’s surgeon was prepared to testify that the 24-hour delay in diagnosis was a substantial factor in causing the patient’s death.

Emergency Room Physician Fails To Consider Pulmonary Embolus

Hallberg Law, P.A. obtained a $625,000 settlement from an emergency room physician for failing to recognize the signs and symptoms of a pulmonary embolus in a 29-year-old woman who presented to the emergency room with sudden onset of chest pain, shortness of breath and wheezing. The patient had multiple risk factors for pulmonary embolus, and the emergency room physician failed to recognize a pattern on the electrocardiogram that was consistent with pulmonary embolus. The patient was discharged from the emergency room with a diagnosis of upper respiratory infection and died two days later of a massive pulmonary embolism. Expert testimony facilitated by Hallberg Law, P.A. established that the appropriate diagnosis in the emergency room and treatment with anti-clotting drugs would have likely prevented the patient’s death.

Pilot Error Causes Crash

Hallberg Law, P.A. helped a client receive an insurance policy limits settlement for the death of a passenger in a single-engine aircraft. The firm’s investigation determined that the pilot was attempting inappropriate low-altitude maneuvers prior to the crash and, therefore, the crash was due to pilot error.

Surgeon Injures Common Bile Duct In Laparoscopic Gallbladder Surgery

A Hallberg Law, P.A. client was awarded $135,000 in a case where a general surgeon failed to recognize appropriate anatomical landmarks while performing a laparoscopic gallbladder removal. This resulted in an injury to the common bile duct, leading to bile duct obstruction. The patient ultimately required an additional surgical procedure, resulting in significant abdominal scarring.

Poorly Repaired Ankle Fracture Leads To Disability

A 59-year-old man received a $172,500 settlement from an orthopedic surgeon who failed to properly repair a complicated ankle fracture. As a result, the patient developed a non-union and required additional surgeries. Hallberg Law, P.A. retained an independent orthopedic surgeon to offer a medical opinion on the situation. The independent expert stated that the post-operative x-rays demonstrated a failure of the operating surgeon to obtain adequate anatomical alignment of the fracture fragments. This was instrumental in obtaining an appropriate settlement.
